(A) Any person, firm or corporation violating any provision of this chapter shall be guilty of a civil violation, except where otherwise specifically provided; and such person shall be guilty of a separate offense for each and every day or portion thereof during which any violation of this chapter is committed or permitted.

(B) Any person, firm or corporation who commits a violation of this chapter after having previously been found responsible for committing a violation of this chapter within a twenty-four (24) month period, whether by admission, payment of the fine, by default, or by judgment after hearing, may be cited for a criminal violation of this chapter.
