13.10.260 Floodways.
Located within the areas of special flood hazard established in Section 13.10.070 are areas designated as floodways. Since the floodway is an extremely hazardous area due to the velocity of floodwaters which carry debris, potential projectiles, and erosion potential, the following provisions apply:
(A) Prohibit encroachment, including fill, new construction, substantial improvements, and other development unless certification by a registered professional engineer or architect is provided demonstrating that encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge (44 CFR Section 60.3(d)(3) and A.R.S. § 48-3609(B)(4)).
(B) If this section is satisfied, all new construction and substantial improvements shall comply with all other applicable flood hazard reduction provisions of this article. (Ord. No. 2004-16, § 4, 8-17-04; Ord. No. 2005-18, § 2, 6-21-05; Ord. No. 2015-05, §§ 1 – 4, 7-21-15. 1976 Code § 19-5-7)
